To comply with the current legislation according to section three of the Spanish Information Society and Electronic Commerce Act (LSSICE), law 34/2002, 11th July: Electronic business communication regulations, articles 21 and 22. www.hardbardstudio.com (hereinafter the “website”), corresponds to Luis Javier Castro Resino (hereinafter, HARDBARD), with NIF ES-53388010L established in C/Julián Romea 19, 7ºD,28003 MADRID (SPAIN).

It adopts the organizational and technical measures stipulated under current legislation to develop a business communication system with website users activated solely at their prior request. Users of this website can withdraw this permission on request by emailing hello@hardbardstudio.com 

Access and/or usage of this website attributes visitors the condition of a user and automatically imply the acceptance by the user of all conditions and stipulations of this legal notice at the time of such access or use occurs.

Terms of Use

The website may provide access to contents such as texts, graphics, photos, logotypes, icons, images, such as the graphic design, source code and software (hereinafter (Content) property belonging to HARDBARD or third parties, which the USER may have access.

The User is aware of and voluntarily accepts that the use of the Website takes place, in any case, under his/her sole and exclusive responsibility.

We, therefore, urge you to communicate to HARDBARD any act that violates these Terms of Use.

The User is under the obligation to access the website and use its contents in a diligent, correct and licit manner, and, in particular, the User agrees to make use of the utilities and/or services offered through the web site acting in compliance with the regulations in force at all times, as well as in good faith, with moral and respectable behavior and in accordance with law and order.

The User shall not be able to use this website for any improper or unlawful purpose, any behavior that may be damaging HARDBARD or to any other third party is strictly forbidden.

The User declares, guarantees and undertakes expressly (i) not to interfere with the Website or the servers connected to the Website and to obey the requirements, systems, and procedures thereof; (ii) not to obtain unauthorised access to other systems through the Website; (iii) not to exert an influence on the Website such as to negatively affect the transactions of other Users; (iv) not to threaten or coerce other Users; (v) not to store or gather personal or professional data of other Users; (vi) not to act in a false and unauthorised manner in the name and on behalf of other persons or entities; (vi) not to engage in practices that constitute unfair competition.

Particularly, the User shall not access the Web Site in a way that it may damage, deteriorate, disable or overload the services and/or information offered, and shall not interfere with the use of these services and/or information regarding other third parties, nor shall the User attempt any access or access any sites, services, computer systems of the web site or networks connected to the web site without authorization when the latter is compulsory for this access, or by means of any acts of intrusion (hacking) or in any other unauthorized way.

Purpose of the processing; data collection, storage, and updating

According to the established by the Spanish Organic Law 15/1999, December 13th, on Personal Data Protection (from now on, PDP), HARDBARD informs to the user that this site has an automated file with commercial data created by ISC and under its responsibility.

The User accepts that HARDBARD may send the User commercial, marketing, and promotional communications by email, fax or any similar electronic means, and therefore the details for these will be used for such communications by virtue of the Spanish Act 34/2002 of 11 July on Services of the Information Society and e-Commerce and the Telecommunications Act 9/2014.

Compulsory or facultative nature of the information provided by the user and veracity of information.

The user guarantees that the personal data he provides is correct and he is responsible for notifying any change to it to HARDBARD. The users will answer in any case, of the veracity of the facilitated information, saving itself the Entity the right to exclude of the services registered to every user who has facilitated false or erroneous information, without detriment to other actions that proceed in Right.

Practices not allowed

HARDBARD reserves the right to delete any user registration that provides with material or information that (i) restrict or entirely prevent other Users from utilising and enjoying the Website; (ii) are illegal, threatening, abusive, harmful, slanderous, defamatory, hateful, racist, obscene, vulgar, offensive, pornographic, disrespectful towards religions or indecent; (iii) constitute or might constitute facts that could give rise to civil or criminal suits; (iv) injure, violate, plagiarise or infringe the rights of third parties, including intellectual and industrial property rights; (v) contain viruses or other harmful components capable of interrupting, destroying or limiting the functionality of any computer programs or equipment; (vi) the User is not entitled to transfer, and (vii) are unsolicited or subliminal advertising materials, or (viii) contain false or deceitful statements and instructions.

Rights of access, rectification, erasure or objection

Likewise, we inform you that you can exercise your rights to access, rectification, and cancellation by sending a letter to HARDBARD, established in C/Julián Romea 19, 7ºD,28003 MADRID (SPAIN) or by sending an e-mail to hello@hardbardstudio.com

This request will have to contain the following information: name and surname(s) of the person who exercises the right, photocopy of identity card or passport, and specific content of the right exercised

Security measures

HARDBARD guarantees the confidentiality and security of the personal data that are processed to the extent that it has implemented the security measures required by Spanish Royal Decree 1720/2007, of December 21, approving the Regulation that Develops the LOPD, whose purpose is to prevent the changing, loss, processing or unauthorized use of your personal data.
